Your privacy is important to us. This Personal Data Protection Notice (“Notice”) explains how Berjaya Vacation Club Berhad and its related and associated companies (“Berjaya Vacation Club”, “we”, “us”, “our”) collect, use, process, store, disclose, transfer, and protect your personal data in accordance with the Personal Data Protection Act 2010 (“PDPA 2010”), the Personal Data Protection Standard 2015, and the Personal Data Protection (Amendment) Act 2024.

This Notice applies to all individuals who interact with Berjaya Vacation Club, including but not limited to customers, clients, vendors, suppliers, contractors, tenants, service providers, website/app users, contest participants, visitors, and other external parties.

This Notice explains how we collect, use, and disclose your personal data. The Personal Data, which you provide or have previously provided to us will be processed, and continue to be processed by us, in accordance with this Notice (as amended, varied, or revised from time to time). If we revise this Notice, we will notify the changes either through our website, or by sending a copy of the revised Notice to you by post or email.

In this Notice,

  • BVC” means Berjaya Vacation Club Berhad (Company No. 237313-P).
  • Berjaya Group” means Berjaya Corporation Berhad and includes its subsidiaries, related and associate companies.
  • Data Subject” means any individual who is the subject of personal data.
  • Holiday Resorts” means the hotels, resorts, condominiums, apartments, chalets, and other accommodations provided or made available to you in connection with your BVC membership, including our affiliate hotels.
  • Personal Data” means any information in our possession or control that relates directly or indirectly to you (or any other individual), to the extent that you (or such other individual) are identified or identifiable from that information or from other information in our possession.
  • Products and Services” means products, services and facilities provided in connection with your BVC membership, including accommodation and facilities at the Holiday Resorts

1. Personal Data

1.1 What Personal Data We Collect

Personal Data we collect about you includes, but is not limited to, the following:

  • personal details such as your name, identity card number or passport number, age, gender, race, nationality, date of birth, address, marital status, contact details (telephone number and email address), and photograph;
  • photographs and contact particulars of your family members who are your supplementary cardholders, nominees, or guests;
  • information relating to the Products and Services you have purchased or registered your interest in, including updates and enquiries;
  • information about your bookings, stays, and facilities utilised at the Holiday Resorts;
  • billing history, payment status, and transaction records;
  • information collected by us, the Holiday Resorts, or the Berjaya Group in relation to any service, transaction, contest, survey, promotion, questionnaire, or communication you have participated in;
  • personal interests or preferences, such as language preferences, product or content interests, and marketing or communication preferences;
  • your image or photograph captured via CCTV or video surveillance installed on our premises for security purposes;
  • username, password, and other identifiers you provide when registering on our website; and
  • information automatically collected when you visit our website, such as your IP address, browser type, and other details about your visit.

Mandatory information: Certain information requested by us is mandatory. You must provide this information and consent to its processing; otherwise, we will not be able to approve or maintain your BVC membership or provide the information, updates, products, or services you have requested. This may include information collected through strictly necessary cookies as described in Section 8 (Use of Cookies).

1.2 How Your Personal Data Is Collected

We collect your Personal Data through various touchpoints, including:

  • when you apply for a BVC membership;
  • when you make a booking for accommodation at any Holiday Resort with us, whether through our website or other available methods;
  • through mobile applications, online booking portals, or our official social media pages;
  • information you provide to us via forms, documents, enquiries, or applications submitted physically or online;
  • when you purchase or register your interest to purchase, or request information or updates regarding the Products and Services;
  • when you enter contests or respond to surveys, promotions, or questionnaires;
  • from third-party sources such as credit reference agencies or publicly available records;
  • from the Holiday Resorts or any company within the Berjaya Group;
  • pursuant to any transaction, enquiry, or communication with us; and
  • when you, your family members, or your guests check in, visit, or utilise the facilities at any Holiday Resort.

1.3 Purpose of Collecting and Processing Your Personal Data

We process your Personal Data for the following purposes:

  • to verify your identity and to process your applications, bookings, purchases, registrations, and transactions;
  • to respond to your queries and provide updates on the Products and Services;
  • for administrative purposes, including billing, payment processing, and debt collection;
  • to conduct research and statistical analysis, and to monitor our services for quality assurance and improvement;
  • to comply with applicable laws, legal proceedings, or enquiries from regulatory authorities and enforcement agencies;
  • to promote other products and services offered by us, the Berjaya Group, or our partners, and for direct marketing purposes (subject to your consent or applicable opt-out rights); and
  • for any other purposes permitted or required by applicable laws.

1.4 Sensitive Personal Data

Sensitive Personal Data” means any Personal Data consisting of information regarding your physical or mental health or condition, political opinions, religious beliefs (or other similar beliefs), the commission or alleged commission of an offence, or any Personal Data prescribed under law as sensitive personal data.

If you choose to submit Sensitive Personal Data to us, such data will be treated as Personal Data and will be subject to this Notice, including its provisions on processing, use, disclosure, security, and retention.

2. Disclosure

Your Personal Data may be disclosed to the following classes of third parties on a need-to-know basis, where necessary, and in compliance with PDPA requirements, including but not limited to:

  • the Holiday Resorts.
  • companies within the Berjaya Group.
  • business partners, joint-venture partners, vendors, suppliers, agents, and appointed service providers (including IT, cloud hosting, cybersecurity, marketing, logistics, courier, customer support, and call-centre services).
  • payment gateways, banks, financial institutions, and payment processors.
  • credit reporting agencies and debt collection agencies (in relation to any debt owing by you to us).
  • regulatory authorities and enforcement agencies.
  • any court of law or any relevant party in connection with any claim or legal proceedings.
  • our contractors, consultants, auditors, and professional advisors; and
  • any actual or potential assignee, transferee, or acquirer of any Berjaya Group company or business, in connection with any corporate exercise.

3. Transfer of Personal Data Outside Malaysia

Your personal data may be transferred, stored, or accessed outside Malaysia for processing, hosting, backup, or other business-related purposes. When such transfers occur, we will ensure that the receiving party provides a level of protection that is comparable to the requirements of the PDPA and that appropriate safeguards are in place to protect your personal data.

4. Accessing and Updating Your Personal Data

4.1 Your Responsibility to Provide Accurate Information

You are responsible for providing accurate and complete information. If the information relating to yourself or others (e.g., your spouse, children, relatives, nominees, guests, or other third parties) becomes outdated or incorrect, please notify us promptly. You confirm that you have obtained the necessary consent or authority to submit the Personal Data of these individuals to us.

4.2 Your Rights

As a Data Subject, you have the right to:

  • access the personal data we hold about you;
  • request the update or rectification of inaccurate, incomplete, or outdated Personal Data;
  • withdraw your consent to the processing of your Personal Data (subject to any applicable contractual or legal restrictions);
  • opt out of receiving marketing or promotional communications from us; and
  • make enquiries or lodge a complaint regarding how your Personal Data is handled.

Requests may be submitted in writing by completing the online Data Subject Rights Request Form, or by downloading and submitting the completed form to the Data Protection Officer via the contact details provided below.

4.3 Our Response to Your Request

Upon receipt of your written request, we may:

  • comply with your request or refuse it (with reasons provided for any refusal); and
  • charge a reasonable fee for processing your request for access or rectification, where permitted by law.

5. Limiting the Processing of Your Personal Data

If you wish to opt out of receiving marketing materials or request that we cease processing your Personal Data for specific purposes, please notify us in writing (see Section 9).

In the absence of written notification from you, we will deem that you consent to the processing, use, and disclosure of your Personal Data in the manner, to the extent, and within the scope set out in this Notice. Please be aware that limiting such processing may result in our inability to maintain your BVC membership or provide the requested services or information.

6. Personal Data Retention

We will retain your Personal Data only for as long as necessary to fulfil the purposes for which it was collected, or as required under applicable laws and regulations. Once retention is no longer required, your Personal Data will be securely and permanently deleted.

7. Security Measures

We implement reasonable and appropriate technical, organisational, and physical safeguards to protect your Personal Data against unauthorised access, disclosure, alteration, or destruction. These safeguards include access controls, secure IT systems, cybersecurity measures, confidentiality obligations, and physical and electronic security controls.

8. Use of Cookies

8.1 Use of Cookies

When you visit and use the BVC website, we may use cookies to support the proper functioning, security, and operation of our website and online services. Cookies are small text files placed on your device (such as a computer, tablet, or mobile phone) when you access a website and help websites function efficiently and securely.

8.2 Types of Cookies Used

At present, the BVC website uses Strictly Necessary Cookies only. These cookies are essential to enable:

  • secure user login and authentication;
  • processing of bookings, reservations, and transactions;
  • maintenance of user sessions and system stability; and
  • protection of the website and users against security threats, fraud, and unauthorised access.

These cookies are required for the website to operate properly and cannot be disabled through our systems.

8.3 No Use of Optional Cookies

As at the date of this Notice, the BVC website does not currently use the following types of cookies:

  • optional functional cookies (for example, preference-based cookies);
  • analytical or performance cookies;
  • marketing or advertising cookies; or
  • tracking or profiling cookies.

Accordingly, we do not collect Personal Data via cookies for analytics, behavioural tracking, advertising, or marketing purposes.

8.4 Consent and Transparency

As the cookies used are strictly necessary for the provision of services requested by you, your consent is not required for the use of such cookies under the Personal Data Protection Act 2010.

This information is provided to ensure transparency regarding our use of strictly necessary cookies. Should BVC introduce any optional cookies in the future, this Notice will be updated accordingly, and appropriate information, choices, or controls will be provided where applicable.

8.5 Managing Cookies

Most web browsers allow you to manage, disable, or delete cookies through browser-level settings. Please note that disabling strictly necessary cookies may affect the availability, functionality, or security of the BVC website and may prevent you from accessing certain features or services.
